WARWICK, RI — A 62-year-old Warwick man is due in court docket Monday on a simple assault charge after punching the bartender at Oakland Seaside Diner March 15 at 10:35 p.m. after the server withdrew his beer and requested him to depart.

When Officer Frank Matarese arrived to examine on the report of a buyer who had attacked an worker and had been restrained, he discovered the bar’s proprietor, Marc Needham, holding a person on the bottom, face up. Matarese requested if the person, Michael S. Dichiara, 62, of 89 Wilson Ave., Warwick, RI, was the one who had struck an worker, and Needham mentioned he was, in accordance with the officer’s report.

Matarese moved Dichiara onto his abdomen and restrained him and handcuffed him, noting his bloodshot eyes and alcohol scent on his breath. The bartender, Shane Buddemeyer, 26, mentioned he would press prices.

Oakland Seaside Diner Assault: Patron beforehand refused service

Based on witness interview and surveillance video of the assault, Dichiara had visited the bar exhibiting indicators of earlier consuming on March 8, and Buddemeyer refused to serve him as a result of his obvious intoxication. Shortly after, Dichiara started “speaking trash,” Buddemeyer instructed Matarese, so the bartender took the beer again. Within the video of the assault, Buddemeyer is seen motioning for Dichiara to depart, in accordance with the report. As an alternative, Dichiara pushes Buddemeyer and punches him together with his proper fist within the left facet of his face, then punches him once more together with his left fist in the correct facet of the face. Needham then grabbed Dichiara from behind, and all three fell to the bottom.

Matarese arrested Dichiara and transported him to Warwick Police Headquarters, 99 Veterans Memorial Drive, the place the officer charged him with easy assualt and disorderly conduct, and positioned him in a cell. Dichiara was additionally issued a no trespass order for the diner. At midnight March 16, officers transported Dichiara to Kent County Memorial Hospital for alcohol detox remedy.
